1. Responsibility for Vehicle Damages

The customer is responsible for any damages caused to the vehicle during the service, whether by the customer or their passengers. This includes damages to the interior or exterior of the vehicle, vandalism, or damages caused by misuse or negligence.

In the event of damages, Black VIP Transport LLC reserves the right to charge the repair costs, as well as any lost revenue due to vehicle downtime, to the credit or debit card provided by the customer. A detailed report of the damages and costs will be provided to the customer.

2. Prohibition of Alcohol and Drug Use

Black VIP Transport LLC reserves the right to deny service to any passenger under the influence of alcohol or drugs in a way that compromises the safety of the driver or the vehicle.

It is strictly prohibited to consume alcohol or illegal substances within the vehicle. If consumption is detected, the service will be immediately terminated, and the customer will be responsible for the full cost of the trip and any resulting damages.

Black VIP Transport LLC reserves the right to terminate the service in the case of illegal, inappropriate, or dangerous behavior, and the full trip cost will be charged without a refund.

3. Driver and Vehicle Protection

Any violent, threatening, or disrespectful behavior towards the driver or the vehicle will result in immediate termination of the service. Black VIP Transport LLC reserves the right to contact authorities if the customer’s behavior endangers the safety of the driver or vehicle.

The customer will be responsible for any damages, losses, or costs resulting from actions that compromise the safety of the driver or the vehicle.

4. Fraud and Protection Against Stolen Credit Cards

Black VIP Transport LLC reserves the right to conduct additional security verifications on all payment transactions. If a credit or debit card is suspected of being fraudulent or reported as stolen, the service will be canceled immediately, and authorities will be notified.

If a transaction is determined to have been made using a fraudulent card, the customer will be responsible for all charges incurred and the full cost of the service.

Black VIP Transport LLC may request additional documentation to verify the customer’s identity and the legitimacy of the transaction before confirming any booking.

5. Owner Liability Release

As the sole owner of Black VIP Transport LLC, the owner will not be personally liable for any debts or claims against the company. All claims and liabilities are limited to the assets of Black VIP Transport LLC, protecting the owner’s personal assets in the event of legal disputes related to accidents, vehicle damages, or financial issues.

6. Compliance with State and Local Laws

All passengers must comply with local, state, and federal laws while using the services of Black VIP Transport LLC. Any illegal activity within the vehicle, such as drug use or possession of prohibited items, will be reported to the authorities.

The service is subject to the laws of the State of New York and the regulations of the Taxi & Limousine Commission (TLC) of New York. Any customer failure to comply with these laws may result in additional legal penalties and immediate service termination without refund.

7. Authorization for Charges for Damages and Misconduct

By using the services of Black VIP Transport LLC, the customer agrees that any damages to the vehicle or any violation of the outlined policies authorizes Black VIP Transport LLC to charge the corresponding costs to the credit or debit card provided. This includes vehicle damages, violations of alcohol or drug policies, and any inappropriate or illegal behavior.


General Terms and Conditions of Service

1. Rates

The rate presented in your reservation confirmation is intended as a good faith estimate of the service cost based on the information provided at the time of booking and does not necessarily reflect the final trip cost. Wait time, taxes, extra stops, or additional services may alter the rate. Final charges will reflect actual usage. Reservations in international markets may incur a mileage charge. Rates are subject to change without notice. Black VIP Transport LLC is not responsible for services delayed or not rendered due to weather conditions or other circumstances beyond its control.

2. Hourly Reservations

Hourly billed reservations are calculated from the exact scheduled pick-up time until the contracted period ends. There is no grace period for this type of reservation; time begins as stipulated. The standard minimum is 2 hours for most vehicles, although some specialty vehicles may require a higher minimum, which will be communicated to the customer at the time of booking.

3. Airport Grace Period

For airport arrivals, Black VIP Transport LLC monitors commercial flights to ensure on-time pickups. A grace period of 30 minutes for domestic flights and 60 minutes for international flights is allowed from the time of landing. Wait time charges will apply after the grace period and will be accrued in 15-minute increments, based on the hourly rate of the vehicle.

4. Non-Airport Pickups

For all other pickup locations, a 15-minute grace period is allowed before wait time charges are applied, which are accrued in 15-minute increments based on the vehicle’s hourly rate.

5. Base Rate, Gratuity, and Fees

The base rate reflects the cost of transportation services before gratuity, ADM, airport fees, fuel surcharge, and taxes.

A discretionary 20% gratuity is added to each reservation and is paid directly to the chauffeur. This gratuity is voluntary and can be adjusted at any time.

All related charges, including ADM, airport fees, tolls, New York congestion surcharges, and fuel surcharges, will be billed as incurred.


Cancellation and Refund Policy

1. Cancellation Notice

All cancellations, whether by email or phone, must be made at least 24 hours before the scheduled pick-up time to qualify for a refund. Cancellations made within 24 hours of the scheduled service will incur the full fare, and no refunds will be issued.

2. Refund Eligibility

Refunds will only be granted for cancellations confirmed at least 24 hours in advance. Cancellations received less than 24 hours before the service will not qualify for a refund, as resources and the driver will have already been allocated.

3. Cancellation Confirmation

It is the customer’s responsibility to ensure their cancellation request has been received and confirmed by our team. If the cancellation is not confirmed, the full fare will be charged for the scheduled trip. Our team will respond to all cancellation communications promptly.

4. No-Show Policy

If the customer fails to arrive at the scheduled pick-up location at the agreed-upon time, it will be considered a No-Show, and the full fare will be charged. No refunds will be issued for No-Shows.

5. Service Availability in Different Locations

Our services are available in multiple locations, including New York and Miami. The geographic location of our main office does not affect our ability to provide service in other cities. Once a booking is confirmed, it is binding, and any misunderstanding regarding the service location does not qualify for a refund.

6. Final Booking Terms

All bookings are considered final once confirmed. No refunds or cancellations will be granted for failure to adhere to the cancellation window or misunderstandings regarding the booking details.


Changes and Cancellations

1. Procedure for Changes or Cancellations

Changes or cancellations may be submitted via email to [email protected], through the customer’s online reservation system, on our website or mobile app, or by calling (347) 477-6476. All cancellations, including those made by phone, require 24 hours’ notice. Failure to provide adequate notice will result in the full fare being charged.


Billing

All reservations are billed in USD.

2. Pre-Authorization

36 hours before your trip, Black VIP Transport LLC will request a pre-authorization of your account for the estimated trip total, plus an additional 30%. This pre-authorization guarantees that funds are available for the service payment. The pre-authorization will be removed once final charges are processed.

3. Final Billing

The final total is calculated after the vehicle returns to our facilities and will be processed within 48 to 72 business hours after the trip is completed. If the customer does not receive a final receipt, they should contact our Accounting department at [email protected].

4. Additional Fees

Any additional fees, including tolls, wait time charges, extra stops, or vehicle damages, will be itemized in the final bill.


No-Show Policy

1. Definition of No Show

A reservation is considered a “No Show” if the passenger cannot be located within 1 hour for airport pickups (starting from the time the plane lands) or 30 minutes at other pickup locations. In such cases, the full fare, including a 20% gratuity, will be charged.

2. Avoiding Being Considered a No Show

To avoid being considered a No Show, if the customer is having trouble locating their chauffeur, they must contact Black VIP Transport LLC at (347) 477-6476 before leaving the pickup location.
